How Much Does it Cost to Appeal?

 

NO REDUCTION - NO LEGAL FEES!

If you would like us to file your appeal, the initial cost is $50.00. This covers the cost of filing the petition, the filing fee and the work that is put into creating the initial evidence package. That is your only upfront fee.

For RESIDENTIAL PROPERTIES, If I am successful in reducing your taxes, my fee is only 45% of the tax saved. If I do not obtain a reduction, then you do not owe the firm anything.

For COMMERCIAL PROPERTIES, the contingency fee is based on the value and complexity of the case. Please call for the rate.

 

 

How Does the Process Work?

When you sign up with the Law Firm of Seth D. Lubin, P.A. to handle your property tax appeal, rest-assured that we will use our very best efforts in an attempt to achieve a tax savings for you.

The first step after you sign our Retainer Agreement is for us to file your appeal petition with the Value Adjustment Board (“VAB” - the governmental body that oversees the appeal). After the September 18th deadline, you will receive a notice from our firm acknowledging that your petition has been filed.

We will then begin the process of creating the evidence package that we must submit on your behalf in order to overcome the County’s presumption of correctness on their value. At this point, please provide us any information that is pertinent to the value (information about renovations, damagers, pictures, etc).

Anytime between the end of October through April, the VAB will set a hearing on your petition. The evidence package will be submitted to the County according to Florida law at least 2 weeks before the hearing. Once the property appraiser receives the evidence package they will either a) call us to discuss a potential settlement; and/or b) submit their evidence countering our value proposal. If we cannot come to an agreement on value, then we will proceed to a hearing.

At the hearing, I will argue on your behalf, what we believe the property is worth, and I will attempt to overcome the County’s presumption of correctness. Although you are welcome to attend the hearing, it is not necessary for you to be there. It usually takes about 2-4 weeks to receive a verdict from the Special Magistrate on your appeal.

If we are successful, your value will automatically be lowered. If you have not yet paid your taxes, the tax bill you receive will reflect the new lower value. If you already paid your taxes, you will receive a refund from the County in about 6-8 weeks after the verdict is final. If you pay your taxes through escrow, your bank will receive the refund check and place it in your escrow account (you can call the bank and have them send you the overage - it is your money!)

Circuit Court Appeals

One of the unique attributes of our firm is our ability to take property tax matters to the next level, specifically, Circuit Court in any county in Florida as well as the Supreme Court of Florida if needed. Our circuit court litigation team is made up of seasoned attorneys who focus on both property tax matters as well as litigation against governmental entities. Our experience, coupled with the relationships we have cultivated over the years, allows us to be efficient when needing to escalate cases beyond the Value Adjustment Board. Although our fee is hourly, we make sure to provide the client with the most cost efficient process that is possible for both parties. In doing so, we make sure that the original tax agent is still part of the deal and not removed from the process.
